Medigap Guaranteed-Issue Rights: When Insurers Can't Say No

Most of the time, buying a Medigap plan means passing health questions. But in certain windows, insurers must accept you regardless of health. Here are your Medigap guaranteed-issue rights.

The Difference Between 'Can Apply' and 'Guaranteed'

Buying a Medicare Supplement isn't always as simple as picking a plan and paying. Outside of certain protected windows, Medigap insurers in Wyoming and Utah can ask health questions and decline you or charge more based on your medical history — a process called medical underwriting. But federal law also creates specific situations where insurers must sell you a policy regardless of health. These are your guaranteed-issue rights, and knowing them can be worth thousands of dollars.

The most valuable window of all is your initial Medigap Open Enrollment: the six months starting when you're 65 and enrolled in Part B. During it, you can buy any Medigap plan sold in your state with no health questions at all. Missing that window is one of the most consequential — and avoidable — Medicare mistakes.

Your Initial Six-Month Window

Your Medigap Open Enrollment Period is a one-time, six-month window that begins the first month you're both 65 or older and enrolled in Part B. During these six months, no insurer can turn you down, charge you more for health conditions, or impose a waiting period for pre-existing conditions (beyond limited exceptions). It's the golden window, and it doesn't repeat.

This is why the Advantage vs. Medigap decision at 65 carries extra weight. If you choose Medicare Advantage first and later want to switch to Medigap, you may face underwriting — as we explain in switching from Advantage to Medigap. Your healthiest, most protected chance to lock in a supplement is right at the start.

The Other Guaranteed-Issue Situations

Beyond that initial window, federal law grants guaranteed-issue rights in specific circumstances, usually with a 63-day window to act:

  • Your Medicare Advantage plan leaves your area or stops offering coverage
  • You move out of your plan's service area
  • Employer or union coverage that supplemented your Medicare ends
  • Your Medigap insurer goes bankrupt or your coverage ends through no fault of yours
  • Trial rights: you tried Medicare Advantage for the first time and switch back within 12 months, or dropped Medigap to try Advantage and return within 12 months

Why Timing Is Everything

Guaranteed-issue rights are time-limited — most run just 63 days from the triggering event — and once they lapse, you're back to underwriting. If any of the situations above applies to you, acting promptly is critical, because the same health changes that make you want better coverage are exactly what underwriting screens for. A missed window can mean being locked out of the plan you want.

Because Wyoming and Utah don't offer the extra year-round Medigap protections some states have, these federal windows are often your only guaranteed shots after the initial six months. If you think a guaranteed-issue right might apply to you right now, don't wait — a quick call to a licensed advisor can confirm your eligibility and get the application in before the clock runs out, at no cost.

Frequently Asked Questions

What is a Medigap guaranteed-issue right?

It's a situation where Medigap insurers must sell you a policy regardless of your health — no medical questions, no denials, no higher price for conditions. The biggest one is your initial six-month Medigap Open Enrollment Period at 65.

How long do I have to use a guaranteed-issue right?

Your initial Medigap Open Enrollment lasts six months. Most other guaranteed-issue rights give you a 63-day window from the triggering event (like losing employer coverage or your plan leaving the area).

Do Wyoming and Utah have extra Medigap protections?

No. Neither state has adopted a 'birthday rule' or year-round guaranteed-issue laws, so the federal guaranteed-issue windows are generally your only protected chances to buy Medigap without underwriting after the initial six months.

Can I be denied a Medigap plan?

Outside of a guaranteed-issue window, yes — insurers can use medical underwriting to decline you or charge more based on health. That's why using your initial six-month window or a guaranteed-issue right matters so much.
